Terms of Service

These terms describe what PALOFIT offers and what we expect from you. We aim for a fair user experience. If something doesn't feel fair, let us know at hello@palofit.io.

Service

PALOFIT is a mobile app that builds you a weekly training program, guides workout sessions, suggests suitable nutrition to support your training, and gives feedback. The service is provided as is, and we continuously develop it — features may be added or change.

Account

You must be at least 16 years old to create an account. Provide us with accurate contact details and be responsible for your own account. We don't recommend sharing your login credentials. You can delete your account at any time in Settings.

Subscription and trial

PALOFIT is a subscription-based service offered through App Store and Google Play. Free trial, pricing and renewal are shown in the store before purchase. You can stop auto-renewal at any time in the store's settings before the next billing period. We cannot process cancellation on your behalf because payment happens directly with Apple or Google.

Right of withdrawal

You have a 14-day right of withdrawal from distance contracts under EU consumer protection law. In practice, our free 14-day trial gives you at least the same time to evaluate the service without payment, and you can cancel in the store's settings at any time during the trial, with no charge. After the trial, any refunds are handled by Apple or Google under their own policies. You can stop auto-renewal at any time before the next billing period. No separate cancellation request is needed.

Health disclaimer

PALOFIT is a fitness and wellbeing app, not a medical, diagnostic or healthcare service and not a medical device. Day signal, nutrition guidance, post-workout feedback and AI summaries are directional training and wellbeing information. They are not a diagnosis, treatment advice, injury-risk assessment, or a decision that training is safe. Physical training and the use of gym, home or other equipment always carry a risk of injury, soreness and health issues. You are responsible for making sure the exercises, loads, equipment and training environment you choose are suitable for your situation. Always follow the instructions from the equipment manufacturer, gym and any professional supporting you. Do not use broken, unstable or unclear equipment. PALOFIT cannot inspect your health status, technique, equipment condition or training environment, and therefore does not guarantee that any individual exercise or workout is safe for you. We recommend consulting a doctor or physiotherapist before starting if you have health concerns, a chronic condition, an injury, are pregnant, or are unsure about safety. Stop training and seek help if you experience dizziness, pain, shortness of breath or other unusual symptoms. This does not limit your rights under applicable consumer protection law.

Acceptable use

Use the service for your own training goals. Don't try to bypass technical limits, copy source code, load the service unnecessarily, or infringe on others' rights. We reserve the right to limit or close accounts for clear violations.

Content and intellectual property

You own your own training data. You grant us a licence to process it to deliver the service (storage, backup, display). The app, program, images and text are owned by PALOFIT or its partners. You have a personal, non-exclusive licence to use them for the duration of the service.

Limitation of liability

We are liable for the service in accordance with the contract and consumer protection law. We are not liable for indirect damages (e.g. lost time or income). We are also not liable for harm caused by training against instructions, careless use, training unsuitable for your health status, broken or incorrectly adjusted equipment, or a training environment we cannot control. Statutory liabilities cannot be limited. Health and training responsibility is covered under the Health disclaimer section.

Termination

You can delete your account at any time in Settings, including during the free trial. We may terminate the agreement if you materially breach these terms or your active subscription expires without renewal. Data is removed in line with the account lifecycle (see Privacy Policy).

Force majeure

We are not liable for service interruptions, delays or errors caused by circumstances beyond our reasonable control. For example, major network outages, our subprocessors' outages, strikes or authority orders. We aim to communicate such situations and restore the service as quickly as possible.

App Store and Google Play terms

PALOFIT is distributed through the Apple App Store and Google Play. When using the app, you also agree to the terms of the store you bought it from. Apple Inc. is not a party to this agreement — the agreement is between you and Palofit Oy. Apple is not responsible for the app or its content and has no obligation to provide support or maintenance. Refunds, where applicable, are handled by Apple under its own policy. The same principle applies to Google LLC for subscriptions purchased via Google Play.

Governing law

These terms are governed by Finnish law. For disputes we aim first for an amicable resolution. Consumer users may use the consumer dispute resolution body of their home country; for users in Finland the forum is the Consumer Disputes Board (kuluttajariita.fi).

Severability

If any provision of these terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Changes to these terms

We announce material changes in the app and by email before they take effect. By continuing to use the service after the changes, you accept the updated terms.
